人力資源(yuan)社(she)會保障部、中華全國(guo)(guo)(guo)總工會、中國(guo)(guo)(guo)企業(ye)(ye)聯合會/中國(guo)(guo)(guo)企業(ye)(ye)家協(xie)(xie)會和中華全國(guo)(guo)(guo)工商業(ye)(ye)聯合會等(deng)國(guo)(guo)(guo)家協(xie)(xie)調勞(lao)動(dong)關系三方日前(qian)下發了《關于(yu)推進新時代和諧(xie)(xie)(xie)勞(lao)動(dong)關系創建活動(dong)的(de)(de)意見》(以下簡(jian)稱《意見》),認真(zhen)貫徹黨(dang)的(de)(de)二十大精神,全面(mian)落實(shi)中共(gong)(gong)中央、國(guo)(guo)(guo)務院關于(yu)構建和諧(xie)(xie)(xie)勞(lao)動(dong)關系的(de)(de)決策部署,在更(geng)大范圍、更(geng)廣層(ceng)次、更(geng)多內容(rong)上不斷豐富和發展和諧(xie)(xie)(xie)勞(lao)動(dong)關系創建實(shi)踐(jian),實(shi)現企業(ye)(ye)和職工協(xie)(xie)商共(gong)(gong)事、機制共(gong)(gong)建、效益(yi)共(gong)(gong)創、利益(yi)共(gong)(gong)享,打造企業(ye)(ye)與職工的(de)(de)利益(yi)共(gong)(gong)同(tong)體、事業(ye)(ye)共(gong)(gong)同(tong)體、命運共(gong)(gong)同(tong)體。
和諧(xie)勞動(dong)(dong)關系(xi)創(chuang)(chuang)建(jian)活(huo)動(dong)(dong)始于2006年,是構(gou)建(jian)中國(guo)特色和諧(xie)勞動(dong)(dong)關系(xi)的(de)重要載體(ti)。國(guo)家(jia)協調勞動(dong)(dong)關系(xi)三(san)方(fang)每三(san)年舉辦(ban)一屆和諧(xie)勞動(dong)(dong)關系(xi)創(chuang)(chuang)建(jian)活(huo)動(dong)(dong),每五年舉辦(ban)一屆全國(guo)和諧(xie)勞動(dong)(dong)關系(xi)創(chuang)(chuang)建(jian)工作先進(jin)集體(ti)、先進(jin)個人評選。面對新(xin)形勢新(xin)任務(wu),國(guo)家(jia)協調勞動(dong)(dong)關系(xi)三(san)方(fang)制定出臺(tai)了(le)《意見》,對新(xin)時代新(xin)征程上和諧(xie)勞動(dong)(dong)關系(xi)創(chuang)(chuang)建(jian)活(huo)動(dong)(dong)進(jin)行再(zai)動(dong)(dong)員再(zai)部署(shu)。
《意見》強調,深入推進(jin)新(xin)(xin)時代和(he)諧勞(lao)(lao)動(dong)關(guan)系創(chuang)(chuang)(chuang)建(jian)(jian)活動(dong)要堅(jian)(jian)持五個基本原則,即堅(jian)(jian)持黨的全面領導,堅(jian)(jian)持增進(jin)民生福祉,堅(jian)(jian)持法治規范保障,堅(jian)(jian)持文化凝(ning)心聚(ju)(ju)力,堅(jian)(jian)持創(chuang)(chuang)(chuang)新(xin)(xin)穩(wen)健并重。同(tong)時,明(ming)確目標任務,力爭到(dao)2027年底(di)各類企業及企業聚(ju)(ju)集區(qu)域普遍開展創(chuang)(chuang)(chuang)建(jian)(jian)活動(dong),實(shi)現創(chuang)(chuang)(chuang)建(jian)(jian)內(nei)容更(geng)加(jia)豐富、創(chuang)(chuang)(chuang)建(jian)(jian)標準(zhun)更(geng)加(jia)規范、創(chuang)(chuang)(chuang)建(jian)(jian)評價更(geng)加(jia)科學(xue)、創(chuang)(chuang)(chuang)建(jian)(jian)激勵措施更(geng)加(jia)完善,創(chuang)(chuang)(chuang)建(jian)(jian)企業基本達到(dao)創(chuang)(chuang)(chuang)建(jian)(jian)標準(zhun),和(he)諧勞(lao)(lao)動(dong)關(guan)系理(li)念得到(dao)廣(guang)泛(fan)認同(tong),規范有序、公正合理(li)、互利共(gong)贏、和(he)諧穩(wen)定的勞(lao)(lao)動(dong)關(guan)系進(jin)一步形成。
《意見》確定了企業、工(gong)業園(yuan)區、街道(dao)(鄉鎮(zhen))的創(chuang)建重點內容(rong)和(he)(he)創(chuang)建標準,即對企業開展創(chuang)建活動(dong)(dong)(dong)的,重點圍繞建立健全(quan)(quan)企業黨組織,全(quan)(quan)面落實勞(lao)(lao)動(dong)(dong)(dong)合(he)同和(he)(he)集體合(he)同制度,加(jia)強企業民主管理,依法保障(zhang)職(zhi)工(gong)勞(lao)(lao)動(dong)(dong)(dong)報酬、休息休假、社(she)會(hui)保險、職(zhi)業技能培(pei)訓(xun)等基本權(quan)益,促進職(zhi)工(gong)工(gong)資合(he)理增長,加(jia)強勞(lao)(lao)動(dong)(dong)(dong)保護,強化(hua)勞(lao)(lao)動(dong)(dong)(dong)爭議預防(fang),培(pei)育企業關(guan)心關(guan)愛職(zhi)工(gong)、職(zhi)工(gong)愛崗(gang)愛企的和(he)(he)諧文化(hua)等開展;對工(gong)業園(yuan)區、鄉鎮(zhen)(街道(dao))開展創(chuang)建活動(dong)(dong)(dong)的,重點圍繞黨委領導的構建和(he)(he)諧勞(lao)(lao)動(dong)(dong)(dong)關(guan)系(xi)工(gong)作機制,建立健全(quan)(quan)勞(lao)(lao)動(dong)(dong)(dong)關(guan)系(xi)協調(diao)機制、矛盾調(diao)處機制、權(quan)益保障(zhang)機制,加(jia)強勞(lao)(lao)動(dong)(dong)(dong)保障(zhang)法律宣(xuan)傳、用(yong)工(gong)指導服務,布局(ju)勞(lao)(lao)動(dong)(dong)(dong)關(guan)系(xi)基層服務站點等開展。
《意(yi)(yi)見(jian)》將(jiang)企業創建標準明確為(wei)9個方面,工業園區(qu)、鄉(xiang)鎮(街道)創建標準明確為(wei)7個方面,確保企業、工業園區(qu)、鄉(xiang)鎮(街道)看得(de)清、夠得(de)著、可參與。值得(de)關(guan)注的(de)是,《意(yi)(yi)見(jian)》要(yao)求創建企業要(yao)針(zhen)對工資等職(zhi)(zhi)(zhi)工關(guan)心的(de)問題定(ding)(ding)期(qi)開(kai)展集體協商并簽訂集體合同;要(yao)定(ding)(ding)期(qi)召開(kai)職(zhi)(zhi)(zhi)工(代表)大會(hui),按規定(ding)(ding)將(jiang)涉及(ji)職(zhi)(zhi)(zhi)工切身利益的(de)規章制度(du)和重大事(shi)項經(jing)過職(zhi)(zhi)(zhi)工(代表)大會(hui)審(shen)議通(tong)過。同時,要(yao)做到職(zhi)(zhi)(zhi)工培訓制度(du)健(jian)全,職(zhi)(zhi)(zhi)工教(jiao)育經(jing)費(fei)足額(e)到位(wei),建立職(zhi)(zhi)(zhi)工健(jian)康服務體系(xi),職(zhi)(zhi)(zhi)工滿意(yi)(yi)度(du)較高等。
全總(zong)權(quan)益(yi)保障部有關(guan)負責人(ren)表示,工(gong)(gong)會組織(zhi)是參與和諧(xie)勞(lao)動(dong)關(guan)系創建(jian)(jian)實踐(jian)的(de)重要力量,《意見》高度重視發揮工(gong)(gong)會組織(zhi)作(zuo)用,工(gong)(gong)業(ye)園(yuan)區、鄉鎮(街道)的(de)創建(jian)(jian)標準包括完善(shan)政府、工(gong)(gong)會、企業(ye)代表組織(zhi)共(gong)同參與的(de)勞(lao)動(dong)關(guan)系協商(shang)協調機制,并依(yi)法建(jian)(jian)立工(gong)(gong)會組織(zhi)、企業(ye)代表組織(zhi)以及(ji)勞(lao)動(dong)爭議調解組織(zhi)等,各級工(gong)(gong)會要切實履行(xing)職責,在新(xin)時(shi)代新(xin)征程上(shang)為構建(jian)(jian)中(zhong)國特色和諧(xie)勞(lao)動(dong)關(guan)系做出應有貢獻(xian)。
《意見》健全了創建(jian)評價機制(zhi),在開展自我評價,協調勞(lao)動(dong)(dong)關(guan)系(xi)三(san)方(fang)定期評審的基礎上,探索引入社(she)會第三(san)方(fang)機構日常綜合評估(gu),并實施(shi)動(dong)(dong)態(tai)管理(li),健全創建(jian)示范單位的動(dong)(dong)態(tai)退(tui)出機制(zhi)。
